Who We Are: My Modern Met Academy takes pride in being a big city that celebrates and encourages creativity. My Modern Met Academy firmly believes that imaginative thinking and human ingenuity help change the world for the better. My Modern Met Academy aims to provide a secure platform for (i) creatives’ work to shine and (ii) people across the globe to connect by appreciating creative work.
Objectives: The present Privacy Policy (the “Privacy Policy”) presents and details My Modern Met Academy’s practices surrounding the collection of personal information, its safeguard and protection as well as its disclosure. This Privacy Policy further seeks to describe the rights granted to users of My Modern Met Academy’s platform with regard to their personal information.
In this Privacy Policy, My Modern Met Academy shall be referred to as “My Modern Met Academy” or “MMMA”. The platform and site(s) operated and managed by My Modern Met Academy shall be collectively referred to as the “Platform”. The Platform is hosted by Thinkific Labs Inc. (referred to as “Thinkific”). Considering Thinkific acts as the Platform’s host, Thinkific handles the storage of data collected from the Platform, effectively utilizing a secure firewall-protected server.
1. Personal Information Provision and Collection: All personal information submitted on the Platform or otherwise received by My Modern Met Academy shall be governed by the terms of this Privacy Policy.
Acceptance of this Privacy Policy
It is recommended that every user of the Platform (each, a “User” and collectively, the “Users”) review this Privacy Policy. Upon visiting, accessing or using the Platform, every User shall be deemed to have read, understood and accepted this Privacy Policy in its entirety and without modification.
Voluntary Provision
There is no requirement to provide personal information to simply visit the Platform. Users of the Platform are invited to enroll as students or subscribe to the Platform. Upon subscribing to the Platform or enrolling as a student on the Platform, a User may be granted access to specialized courses and content. Users may purchase courses by following the instructions provided on the Platform.
Users of the Platform may voluntarily provide personal information upon accessing or otherwise using the Platform. My Modern Met Academy shall collect any information that is directly and voluntarily provided by Users on the Platform. When participating in a course on the Platform, Users may elect to add comments, publish posts, course reviews and other public information. All such information shall be provided voluntarily and as such, shall be received and collected by My Modern Met Academy.
Any information that is voluntarily provided on the Platform, such as comments and posts, may be published on the Platform and available to the public. A User may delete comments and posts at any time, acknowledging that MMMA may retain copies thereof in its caches and archived pages. MMMA shall not be held responsible if any Users copied or saved the information prior to its deletion from the Platform.
Users may update their account information at any time and at their discretion by following the instructions on the Platform and by adjusting settings. Users may elect not to provide or otherwise update their personal information on an as needed basis, recognizing that the failure to provide or update may result in MMMA not providing certain services to such User.
Direct and Indirect Information Provision
To benefit from the services, content and courses offered on and via the Platform, each User shall be encouraged to create a user account on the Platform. Each User may provide personal information as part of his, her or their user account(s). My Modern Met Academy shall obtain access to the information inputted by the User, which may include the User’s name and email address.
When enrolling in a course on the Platform, Users may be asked to provide personal information, such as their name, email address and payment information. Such personal information shall be collected and stored by My Modern Met Academy in accordance with the terms of this Privacy Policy.
In addition, when purchasing a course or content from the Platform, Users shall be required to provide their payment information to complete the transaction. My Modern Met Academy shall then gain access to Users’ purchase history, past and current transactions and other similar information regarding purchases on the Platform.
Users may login into their user accounts via a third party service, including, without limitation, Facebook Connect, Google and other social media platforms. If a User logs into its user account on the Platform via a third party service, My Modern Met Academy shall gain access to public information from the User’s account on the third party site.
Further, Users may be invited to participate in surveys and questionnaires on the Platform. Users acknowledge that unless otherwise indicated, My Modern Met Academy shall have access to all information and data inputted in the surveys or questionnaires, as applicable.
My Modern Met Academy may receive personal information from third party sources, including but not limited to advertising partners, payment processing companies, customer support and other service providers. MMMA shall collect this information in order to provide services on the Platform, improve the Platform and otherwise manage the Platform, its features and services. My Modern Met Academy shall not be responsible for verifying the accuracy of the personal information provided by third party sources. Furthermore, My Modern Met Academy shall be unable to control how the third party sources use and collect Users’ personal information. Users are therefore encouraged to review all third parties’ Privacy Policies to obtain information regarding their usage, collection and storage of personal information.
Further to the User’s creation of a user account, My Modern Met Academy may obtain information relating to indirect identifiers regarding the User, such as the location from which the User accessed the Platform.
2. Consent: Any User of the Platform may consent to My Modern Met Academy using its personal information for purposes beyond those specified in this Privacy Policy. To be valid, any such consent shall be provided in writing by the User. The User providing the specific consent shall be at least eighteen (18) years of age and legally capable of providing a valid consent. Any such consent may apply to the disclosure, collection, handling, storage and usage of the User’s personal information.
My Modern Met Academy may request a User’s consent to participate in a marketing initiative or for any other reason. A User may then approve such request by checking off the box identified to this effect on the Platform. The checking of such a box on the Platform shall be construed as the User’s consent granted to My Modern Met Academy.
If the consent provided by the User complies with the requirements specified in this Privacy Policy, My Modern Met Academy shall use the User’s personal information in accordance with the consent provided. The consent may be provided for a predetermined period. If the consent is limited in time, My Modern Met Academy shall use the User’s personal information for the duration authorized by the consenting User.
3. Payment Information: My Modern Met Academy has retained a third party payment processing company to process payments for courses and content available for purchase on the Platform. Any information relating to payments and payment methods shall be handled by the payment processing company selected by My Modern Met Academy. My Modern Met Academy and the selected payment processing company shall maintain the security and confidentiality of the payment information provided by the User. Users’ purchase history and transaction data shall be maintained for the duration necessary to effect the transaction at hand.
As such, My Modern Met Academy shall ensure all payments made on the Platform are encrypted and comply with the Payment Card Industry Security Standard (PCI-DSS). The standards set out and managed by the PCI-DSS are intended to protect the security of credit card information provided online and to different service providers.

4. Permitted Usage of Personal Information: Upon My Modern Met Academy’s legitimate collection of personal information from the Platform, My Modern Met Academy shall use such personal information solely for the purposes specified in this Privacy Policy. My Modern Met Academy’s usage of personal information shall be limited to the extent required: (i) to provide services and courses on the Platform, (ii) for legitimate business interests, and (iii) according to the consents provided.
When Users correspond with My Modern Met Academy for any reason, Users recognize that such correspondences may be collected by My Modern Met Academy. My Modern Met Academy shall use such correspondences to respond to User questions, concerns and comments. Moreover, My Modern Met Academy may use such correspondences for a specific purpose upon request by the involved User.
My Modern Met Academy may use a User’s personal information to notify the User of changes to a course, request feedback, request the completion of a survey or ask for an opinion.
My Modern Met Academy may use personal information to send emails and newsletters regarding the Platform, its services and any promotions that may be of interest. My Modern Met Academy may also use personal information to send promotional emails and updates regarding the Platform and its services. Using personal information, MMMA may provide personalized recommendations and content regarding course progress, promotional efforts, customized offers and content.
Users may opt out of receiving such emails from My Modern Met Academy by unsubscribing to the newsletter, opting out or adjusting the applicable preferences accordingly. Users may send an email to MMMA ([email protected]) to request to opt out of receiving MMMA’s newsletter and promotional emails. Please note that it is not possible to opt out of receiving emails relating to user accounts, course enrollment and payments, including emails pertaining to account verification email, enrollment and course completion, payment confirmation(s),
The Platform may use push notifications to provide reminders and recommendations to Users. Users may control or disable push notifications provided on the Platform by following the instructions provided or by adjusting settings. By disabling push notifications, certain features of the Platform may not be available or fully accessible to the User.
Legal Purposes
From a strictly legal standpoint, My Modern Met Academy may use personal information collected to: (i) comply with a court order or applicable law, (ii) for reasons of public interest or as part of the public domain; (iii) to safeguard the Platform and the data contained thereon, (iv) to exercise any rights available to it and/or (v) according to a User’s written consent, as more amply described in this Privacy Policy.
Analytical Purposes
My Modern Met Academy shall gain access to anonymous data on the Platform. Such data shall not personally identify any User and may be shared with third parties for statistical or analytical purposes.
5. Cookies and Similar Technologies: Cookies, also known as browser cookies, consist of small data files downloaded or placed on the hard drive or mobile device used by the User accessing the Platform. Cookies allow website operators to be notified that a User visited a particular page, without granting access to such User’s device. As such, cookies allow My Modern Met Academy to track sessions and usage of the Platform, thereby allowing for constant improvement.
My Modern Met Academy shall use cookies on the Platform to help provide Users with a more personalized experience by recognizing the device used to access the Platform. This shall ensure any preferences selected by Users are saved and do not need to be reentered. My Modern Met Academy also uses cookies to provide targeted ads based on interests. MMMA further employs the use of cookies to secure information regarding Users’ selected preferences and other options to enhance the Users’ experience.
It is possible to disable cookies by adjusting data settings or by turning off cookies, however portions of the Platform may not function optimally if cookies are disabled or removed.
Users acknowledge that third party ads use cookies to monitor Users’ Internet activity in order to submit targeted ads. This concept is known as behavioral advertising or targeted advertising. In accordance with the terms of the General Data Protection Regulation, as applicable in the European Union and European Economic Area, it is possible to opt out of receiving targeted ads from third party vendors.
My Modern Met Academy further employs automated tracking methods on the Platform for analytical purposes, namely to assess User engagement and the efficiency of the services and content offered on the Platform. My Modern Met Academy may also utilize various web analysis tools to collect information regarding anonymous information regarding the usage of the Platform. Such web analysis tools may be integrated in the Platform.
6. Disclosure of Personal Information: My Modern Met Academy may disclose personal information in the limited instances set out in this Privacy Policy. The disclosure of personal information shall comply with the terms of this Privacy Policy. In addition thereto, all Users shall benefit from a series of rights in connection with its personal information as detailed in this Privacy Policy.
Instructors and Affiliates
My Modern Met Academy may disclose personal information to allow Users to benefit from the courses and services offered on the Platform and/or to fulfill any purpose listed in this Privacy Policy. Consequently, My Modern Met Academy shall share personal information with instructors, students and MMMA’s affiliates, employees, social media platforms and third party service providers if required to provide the services available on the Platform.
MMMA shall ensure that any disclosure of personal information to third parties is limited only to the information strictly required for the provision of services and the purposes of the Platform. Further, My Modern Met Academy shall disclose personal information only to third parties who remain bound by strict confidentiality obligations.
Notwithstanding the foregoing, please be advised that instructors on the Platform are neither employees nor contractors of My Modern Met Academy. The instructors are independent third parties. Any transaction between a User and an instructor shall not involve MMMA. MMMA has no control over actions, statements, omissions or behavior by instructors, nor does MMMA wish to exercise such control over instructors. As a result, MMMA disclaims any and all liability for any action, inaction, omission or act performed by the instructor(s).
Third party service providers, such as payment processors and content providers, may have implemented their own privacy policies, which detail their collection and usage of personal information. For the most part, third party service providers shall undertake to collect and use only such information that is required for the performance of their respective services. My Modern Met Academy recommends that Users get familiarized with the third party service providers’ privacy policies to understand how they handle personal information. Please note that some service providers may be located in a different jurisdiction, and therefore may be subject to different laws and regulations.
7. Third Party Links: The Platform may include affiliate links and external links to third party websites and applications. The present Privacy Policy shall only apply to the Platform, and not to any third party websites and applications. Each third party website and application is external to the Platform, and shall be governed by its own privacy policy and terms. The links to the third party websites and applications are provided exclusively for reference purposes.
8. Change of Control: My Modern Met Academy may share personal information, such as names, email addresses and content published on the Platform, if My Modern Met Academy is party to a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or in preparation for any of these events. My Modern Met Academy’s successor shall likely receive User names, emails and content published on the Platform as part of the transaction, subject to the terms of this Privacy Policy and any applicable privacy laws.
9. Information Storage and Safety: My Modern Met Academy shall store and process all personal information in its servers located in the United States servers or in a third party hosting service provider’s servers, as applicable.
The personal information collected on or through the Platform shall be stored and maintained in My Modern Met Academy’s servers or in a mandated third party’s servers.
All information held by My Modern Met Academy shall be stored for the duration required to fulfill the objective for which it was collected. My Modern Met Academy undertakes to not maintain information on file for an excessive duration.
Upon the termination or deactivation of a user account, the information in connection with such user account shall remain in the Platform’s servers for backup and archiving purposes for a commercially reasonable duration considering the purpose, applicable laws and the consents provided by the User. Any public information shall remain available and stored for an indefinite duration, unless otherwise determined by My Modern Met Academy.
Internet Safety
Considering information transmitted via the Internet always involves a certain amount of risk, MMMA recommends that Users select a strong password to protect their user accounts. In the event that a User has reason to believe its user account or password has been compromised, the User shall modify its password and take measures to protect the safety of its account. The User shall further contact My Modern Met Academy’s support team to notify them of the incident or security threat. My Modern Met Academy shall then take reasonable measures to protect the User’s account and notify the User of any compromised information, the whole in accordance with applicable laws.
Information Safety
My Modern Met Academy is committed to protecting and safeguarding all personal information provided on the Platform or obtained from the Platform. MMMA takes precautions to ensure personal information obtained from the Platform is not subject to unauthorized disclosure, misuse, deletion or destruction. Such precautions include complying with all standards established by the PCI-DSS.
10. Limited Warranties and Liability: Despite My Modern Met Academy’s precautions, My Modern Met Academy is unable to provide any guarantees or warranties regarding the usage of the personal information collected from the Platform. My Modern Met Academy disclaims liability for any third party usage of the personal information, any third party functionalities or security.
11. Social Media Features: The Platform may include social media features, such as the Facebook Like button, Instagram buttons and other social media widgets. These features may allow for the collection of Users’ IP addresses, and may set a cookie or tracking technology to ensure the proper functioning of the feature. Social media features and widgets are hosted by a third party. Any User’s use of these features shall governed by the privacy policy of the third party providing it. Such third party widgets and features shall not be governed by this Privacy Policy.
My Modern Met Academy may present targeted ads via social media platforms, including Facebook, Instagram, Twitter and other social media platforms. Social media platforms tend to work with interest-based advertising programs, thereby allowing for direct advertisements based on interests, demographics and preferences. To not receive targeted ads, Users may adjust ad preferences or settings on the device used to access the Platform.
12. Applicable Legislation: The Platform is intended for Users residing in the United States. Accordingly, this Privacy Policy has been prepared in accordance with privacy and confidentiality laws applicable in the United States. There is currently no privacy law equivalent or similar to the General Data Protection Regulation 2016/679, which applies in the European Union (EU) or in the European Economic Area (EEA).
My Modern Met Academy is unable to warrant that the terms of this Privacy Policy comply with international privacy laws applicable outside of the United States.
Section § 1798.83 of the California Civil Code grants California residents the right to request information regarding the disclosure of their personal information for direct marketing purposes. California residents can address any request under Section § 1798.83 of the California Civil Code to My Modern Met Academy by email to [email protected], ensuring the subject of the email is California Privacy Rights.
13. Minor Users: The Platformed is designed and intended for Users have reached the legal age of consent. My Modern Met Academy shall not knowingly target or advertise to minors. Minor Users are discouraged from accessing the Platform, unless the User has secured the consent of its parent or legal guardian and provided the parent or lawful guardian accompanies the minor User during the usage of the Platform. In such cases, the User’s parent or legal guardian shall be fully responsible for ensuring the minor User’s usage of the Platform complies with applicable laws and standards.
Any User that has not reached the age of majority in the state of the User’s residence should not provide personal information on the Platform. If My Modern Met Academy has unknowingly collected personal information from a minor, My Modern Met Academy shall delete such information as soon as it is brought to My Modern Met Academy’s attention.
Any User who is below the legal age of consent may request that its personal information be anonymized or deleted. Any such requests should be addressed to [email protected]. My Modern Met Academy shall employ commercially reasonable efforts to delete personal information upon receiving such a request, however, some personally identifiable information may not be removable. Please be advised that My Modern Met Academy may not delete information that is used by a third party.
14. Third Party Websites and Services: The present Privacy Policy shall apply solely to information collected from or via the Platform, and shall not apply to any third party links, services, websites and/or applications (collectively, the “Third Party Websites”). Some sections of the Platform may provide links and access to Third Party Websites.
All Third Party Websites referenced on the Platform are not necessarily affiliated with My Modern Met Academy. Any provision of personal data or information on Third Party Websites shall be governed by the Third Party Websites’ privacy policy and terms, and not by the present Privacy Policy. My Modern Met Academy shall not be responsible for any personal data or information provided to Third Party Websites.
15. Revisions to this Privacy Policy: My Modern Met Academy reserves the right to change, amend, modify or otherwise update this Privacy Policy, at My Modern Met Academy’s sole discretion. The updated Privacy Policy shall be published on the Platform and shall specify the date of the latest revision made thereto.
The updated Privacy Policy shall be applicable as of the date of its publication on the Platform unless another application date is specified. Any usage of the Platform by a User following the publication of the revised Privacy Policy shall be construed as the User’s acceptance of the revised Privacy Policy.
